DRAFT WARRANT

Town of Leverett

Special Town Meeting

Tuesday, October 25, 2011

7:00 P.M. Leverett Elementary School

Franklin, SS.

To One of the Constables of Leverett:

Greetings:

 

In the name of the Commonwealth, you are hereby directed to notify and warn the inhabitants of Leverett, qualified to vote in Town affairs, to meet in the Elementary School auditorium, on Tuesday the 25th of October, 2011, at 7:00 in the evening (7:00 p.m.), then and there to act on the following articles, namely:

 

Article One:  To see if the Town will vote to authorize the Selectboard to take all necessary and appropriate action to establish and to maintain, in accordance with the provisions of Chapter 164 of the General Laws and in accordance with the rules, regulations and orders of the Department of Public Utilities and the Department of Telecommunications and Cable, a municipal lighting plant for all purposes allowable under the laws of the Commonwealth, including without limitation the operation of the telecommunications system and any related services, or take any action relative thereto.

Article Two: To see if the Town will vote to appropriate from available funds the sum of $1,000 to pay a one-time membership fee to the WiredWest Communications Cooperative, or take any action relative thereto.

Article Three:  To see if the Town will vote to create a special unpaid committee to be known as a Regional School District Planning Committee, to consist of three members, including one member of the School Committee, to be appointed by the moderator. Regional School District Planning Committees from any one or more towns may join together to form a Regional School District Planning Board or Boards. Such Regional School District Planning Board shall organize forthwith upon its formation by the election of a Chairperson and Secretary-Treasurer, or take any action relative thereto.

Article Four:  To see if the Town will vote to convey, for the sum of $1.00, Parcel B, as shown on the Plan prepared for the Inhabitants of the Town of Leverett dated September 16, 2011 by Harold L. Eaton and Associates, containing 0.2992 +/- acres to Henry G. Barry and to use any remaining funds from Article 17 of the April 24, 2010 Annual Town Meeting to pay for expenses incurred by such transfer including, without limitation, costs of survey and recording, or take any action relative thereto.

Article Five:  To see if the Town will vote to appropriate from available funds the sum of $28,900 to pay for design expenses related to connecting the houses whose water is affected by the landfill to the Amherst Public Water System, or take any action relative thereto.

Article Six:  To see if the Town of Leverett will vote to appropriate or raise through donations or other means, and authorize the Treasurer with the approval of the Selectboard to borrow up to the sum of $434,250, contingent upon the award of a Massachusetts LAND Grant and contingent upon approval of the required local match from Community Preservation Funds, for the purpose of purchasing a Conservation Restriction as defined in and authorized by Sections 31-33 of Chapter 184 of the General Laws and otherwise by law for agricultural, conservation and passive recreation purposes, by negotiated purchase the Teawaddle Hill Farm consisting of 147 acres, more or less, as shown on Assessors Map 7 Lot179; that said Conservation Restriction be conveyed to said Town of Leverett under the provisions of Massachusetts General Laws, Chapter 40, Section 8c, and as it may hereafter be amended and other Massachusetts statutes relating to Conservation, to be monitored and controlled by the Conservation Commission of Leverett, and the Conservation Commission be authorized to file on behalf of Leverett any and all applications deemed necessary for grants and /or reimbursements from the Commonwealth of Massachusetts deemed necessary under Chapter 132A, Section 11 and/or any others in any way connected with the scope of this Article, and the Leverett Selectboard be authorized to enter into all agreements and execute any and all instruments as may be necessary on behalf of Leverett to affect said purchase, or take any action relative thereto.

Article Seven:  To see if the Town will vote to appropriate from available funds the sum of $18,750 to install a fire access emergency water storage tank in the field between the Elementary School and the Library, such appropriation to be contingent upon the receipt of the town of the remaining $56,250 estimated project expense from the Hazard Mitigation Grant Program administered by the Massachusetts Emergency Management Agency, or take any action relative thereto.

Article Eight:  To see if the Town will vote to transfer the sum of $2,157.56 from the funds appropriated by Article Nine of the April 24, 2010 Annual Town Meeting to match grants funds to acquire new Self Contained Breathing Apparatus (SCBA’s) and 4” hose, such transfer to be contingent upon the receipt of the town of the remaining $41,990 project expense from the Assistance to Firefighters Grant Program administered by the Federal Emergency Management Agency, or take any action relative thereto.

Article Nine:  To see if the Town will vote to transfer from available funds the sum of $29,000 to the FY 2012 School Health Insurance Account (acct number 300-914) to cover additional health insurance expenses, or take any action relative thereto.

Article Ten:  To see if the Town will vote to transfer from available funds the sum of $8,625 to the FY 2012 Highway Expenses Account (acct number 422), to cover additional expenses incurred during the Cave Hill Road Bridge repair, or take any action relative thereto.

Article Eleven:  To see if the town will vote to appropriate from available funds the sum of $16,324.42 to pay for emergency repair work completed under the Cave Hill Road bridge, or take any action relative thereto.

And you are hereby directed to serve this Warrant by posting up attested copies thereof on the Post Office, in the Town Hall and Congregational Church at Leverett, the Baptist Church at North Leverett and the Village Co-op at Moores Corner, fourteen days at least before the day of said meeting.
